Article 324. Breach of sanitary, epidemiological and environmental requirements for environmental protection

Part 1. Breaching sanitary, epidemiological or environmental requirements, or hygienic standards for environmental protection, except in cases covered by Article 416 of the Code, entails a warning or a fine.

Article 324, Part 2. Instructions or permissions issued by officials

An official who gives instructions or permission to exceed or understate established sanitary, epidemiological or environmental protection norms is subject to a fine of 25 MCI.

Article 334. Operation of motor vehicles and other mobile equipment exceeding pollutant emission limits

Part 1. Operating motor vehicles, other mobile equipment or installations whose emissions contain pollutants, or whose operating noise levels, exceed the established limits (technical standards) entails a fine.

Part 2. Repeating the same offence within one year after an administrative penalty has been imposed entails a higher fine.

Application of the provisions and calculation of fines

MCI is the monthly calculation index (MRP in Russian, AEK in Kazakh). Penalties are shown in the units prescribed by the Code. The amount in tenge is determined using the applicable MCI and the statutory calculation rules.

Articles 324 and 334 establish liability for specific environmental violations. Application depends on the elements of the offence, the category of the liable party and whether the offence is repeated.
